Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website and the Maya mobile app provided by Fortify Learning ("we," "us," or "our") (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

If you downloaded the Maya app from the Apple App Store, the terms in Section 12 (Apple App Store Terms) also apply to you.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. If you are between 13 and 18 years old (or the age of legal majority in your jurisdiction), you may use the Service only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

2. Accounts

You can create an account in the app using an email magic link or Sign in with Apple. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use of your account.

3. Subscriptions, Free Trials, and Billing

Premium subscription. Portions of the Service are available only with a paid subscription ("Premium"). Premium currently provides unlimited access to lessons at your level, with new content added periodically. We may change the features included in Premium from time to time; if we materially reduce what Premium includes during a period you have already paid for, we will notify you.

Billing through the App Store. Premium subscriptions purchased in the iOS app are billed by Apple through your Apple Account, not by us. The price and billing period are displayed in the app before you subscribe.

Free trial. If a free trial is offered, you will not be charged during the trial period. Unless you cancel at least 24 hours before the end of the trial, your subscription will begin automatically and your Apple Account will be charged the subscription price shown at sign-up.

Automatic renewal. Subscriptions renew automatically at the end of each subscription period, and your Apple Account will be charged for the next period within 24 hours before the current period ends, unless you cancel at least 24 hours before renewal.

How to cancel. You can cancel your subscription at any time in your device's App Store subscription settings (Settings → [your name] → Subscriptions). Deleting the app or deleting your Fortify Learning account does not cancel your subscription. If you cancel, you will keep Premium access until the end of the period you have already paid for.

Refunds. Purchases made through the App Store are subject to Apple's refund policies. To request a refund, contact Apple. Except where required by law, we do not provide refunds or credits for partial subscription periods.

Price changes. If the subscription price changes, the new price applies only to renewals after the change, and Apple will notify you in advance as required by its policies. You can decline the new price by cancelling before renewal.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful, harmful, or fraudulent purpose;
• Submit content that is unlawful, infringing, or offensive;
• Interfere with or disrupt the integrity or performance of the Service;
• Attempt to gain unauthorized access to any part of the Service or its systems;
• Reproduce, distribute, or create derivative works from our content without permission; or
• Use the Service to infringe the rights of others.

We may suspend accounts that violate these Terms.

5. Intellectual Property

The Service and all content, features, and functionality contained within it are owned by Fortify Learning or its licensors and are protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.

6. AI-Generated Content

Pronunciation scores, tutor responses, and other feedback in the app are generated automatically by artificial intelligence and may be inaccurate, incomplete, or inappropriate for your situation. They are provided for educational practice only and do not constitute professional instruction, assessment, or certification of language proficiency. We may use your interactions with the Service to operate, maintain, and improve the Service, as described in our Privacy Policy.

7. Termination

We may suspend or terminate your access to the Service for conduct that we reasonably believe violates these Terms or is otherwise harmful to the Service or other users. Where practicable, we will provide notice before termination. You may stop using the Service and permanently delete your account at any time from Profile → Delete Account in the app.

If we terminate your account without cause while you have an active paid subscription, your sole remedy is a pro-rata refund of the unused portion of your current subscription period, which you may need to request through Apple for App Store purchases. If we terminate your account for a violation of these Terms, you are not entitled to any refund except where required by law.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

9. Limitation of Liability

To the maximum extent permitted by law, Fortify Learning shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service. To the maximum extent permitted by law, our total liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months before the claim arose, or (b) fifty U.S. dollars ($50). Some jurisdictions do not allow the limitation of liability for certain damages, so some of the above limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. If the changes are material, we will provide notice through the app or by email before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of those courts. If you are a consumer resident in a jurisdiction whose law grants you mandatory rights or a mandatory forum, nothing in this section deprives you of those rights.

12. Apple App Store Terms

If you downloaded the app from the Apple App Store, the following additional terms apply:

• Parties. These Terms are an agreement between you and Fortify Learning only, not with Apple Inc. ("Apple"). Apple is not responsible for the app or its content.
• License scope. The license granted to you is limited to a non-transferable license to use the app on Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
• Maintenance and support. Fortify Learning, not Apple, is solely responsible for providing any maintenance and support services for the app. Apple has no obligation to furnish any maintenance and support services for the app.
• Warranty. Fortify Learning is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any) to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are Fortify Learning's sole responsibility.
• Product claims. Fortify Learning, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and/or use of the app, including: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
• Intellectual property claims. In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, Fortify Learning, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Developer contact. Questions, complaints, or claims regarding the app should be directed to Fortify Learning at info@fortifylearning.com, or by mail at 680 2nd St, San Francisco, CA 94107, USA.
• Third-party terms. You must comply with applicable third-party terms of agreement when using the app (for example, your wireless data service agreement).
• Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary of these Terms.

13. General

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fortify Learning regarding the Service and supersede any prior agreements on that subject.
